Terms and Conditions for Membership

This document outlines the terms and conditions governing the membership of the South India Hajj and Umrah Association (hereinafter referred to as "SIHUA" or "the Association"). All members, whether paid or unpaid, who register either through the official website (www.sihua.in) or manually, are bound by these terms and conditions. By applying for or maintaining membership, you agree to comply with these terms and conditions.

1. Membership Categories
1.1 Paid Members: Members who have paid the required membership fees and enjoy access to the full range of benefits offered by SIHUA.
1.2 Unpaid Members: Members who are registered without paying a fee but have limited access to SIHUA’s benefits and services.

2. Eligibility for Membership
2.1 All applicants must be individuals or entities engaged in Hajj and Umrah-related services, including but not limited to tour operators, travel agents, and service providers.
2.2 Applicants must comply with all applicable Indian and Saudi laws, as well as industry norms and SIHUA’s code of conduct.
2.3 Applicants must provide valid and up-to-date credentials, including but not limited to:

IATA License
-
GST Registration
-
Shop and Establishment Certificate
-
MSME/Udyog Aadhaar Certificate
2.4 SIHUA reserves the right to verify and validate all credentials provided.

3. Rights and Obligations of Members
3.1 Rights of Members:

Access to SIHUA’s resources and tools, including training, compliance guidance, and expert consultations.

Inclusion in SIHUA’s directory of verified members.

Access to SIHUA’s network of authentic suppliers.
3.2 Obligations of Members:

Maintain ethical business practices and uphold the integrity of the Hajj and Umrah industry.

Comply with all applicable laws and regulations.

Follow SIHUA’s guidelines on branding, communication, and representation.

Regularly update SIHUA with any changes to credentials or business status.​

4. Membership Fees and Renewal
4.1 Membership fees, if applicable, must be paid at the time of registration and annually thereafter.
4.2 Non-payment of fees within the specified timeframe may result in suspension or termination of membership.
4.3 SIHUA reserves the right to revise membership fees with prior notice to members.

5. Code of Conduct
5.1 Members must:

Refrain from fraudulent practices.

Deliver promised services to customers with transparency and professionalism.

Respect other members and maintain the reputation of the Association.
5.2 Members must not:

Misuse SIHUA’s branding or name.

Create unauthorized groups or platforms in the Association’s name.

Engage in activities that harm the Association’s credibility or other members.

6. Use of Branding and Communication
6.1 Members are prohibited from using SIHUA’s branding, logos, or name without formal written approval.
6.2 No member may create WhatsApp groups, social media platforms, or any other forums in the Association’s name or an implied form that may mislead others.
6.3 Unauthorized use of SIHUA’s branding or misrepresentation of the Association will result in disciplinary action, including potential termination of membership.

7. Termination of Membership
7.1 SIHUA reserves the right to terminate membership for the following reasons:

Serious violations of the terms and conditions.

Non-compliance with Indian or Saudi laws.

Non-payment of membership fees (if applicable).

Conduct detrimental to the Association’s reputation.
7.2 Terminated members will forfeit all rights and benefits associated with membership.

8. Limitation of Liability
8.1 SIHUA is not responsible for the actions or misconduct of any member or third party.
8.2 The Association does not guarantee the performance or reliability of any member’s services.
8.3 SIHUA’s role is limited to providing guidelines, resources, and a platform for members and does not extend to arbitration or litigation.

9. Confidentiality and Data Protection
9.1 Members’ personal and business information will be collected, stored, and processed in accordance with applicable data protection laws.
9.2 SIHUA reserves the right to share member credentials publicly as part of its transparency efforts, subject to prior notice.

10. Dispute Resolution
10.1 SIHUA will not arbitrate or mediate disputes between members, or between members and non-members.
10.2 Members are encouraged to resolve conflicts professionally and independently.

11. Amendments to Terms and Conditions
11.1 SIHUA reserves the right to amend these terms and conditions at any time with prior notice to members.
11.2 Continued membership following amendments constitutes acceptance of the updated terms.
12. Governing Law
12.1 These terms and conditions are governed by the laws of India.
12.2 Any disputes arising from membership will be subject to the exclusive jurisdiction of courts in India.

13. Acceptance of Terms
By registering as a member of SIHUA, you acknowledge that you have read, understood, and agree to abide by these terms and conditions in full.
